African Rainbow Capital (ARC), led by Patrice Motsepe, has petitioned a South African court to compel the US-based Pula Group to file legal documents in an ongoing $195 million lawsuit. The suit revolves around an alleged confidentiality breach stemming from a 2019 non-disclosure agreement regarding a mining project in Tanzania. Pula Group contends that ARC and its associates improperly shared sensitive information leading to ARCH Sustainable Resources partnering with Evolution Energy Minerals, a competitor. Though initially pursued in Tanzania, ARC is advocating for the matter to be heard in Johannesburg, challenging its liability based on not signing the agreement. ARC accuses Pula of stalling the process by frequently changing attorneys, creating delays. The case has seen protracted interlocutory proceedings in Tanzania, where Motsepe’s entities suffered from a default judgment due to service issues. Pula Group, led by Charles Stith, remains skeptical about the initial court order processes and seeks additional documentation before responding. This complex case underscores jurisdictional disputes and procedural intricacies in international commercial litigation.
